The ICC International Court of Arbitration learned with great sadness that our colleague and friend Luiz Olavo Baptista had passed on 18 October 2019 in São Paulo.

Luiz Olavo Baptista, born in the city of Itu, in 1938, graduated in Law and Social Sciences from the Pontifical Catholic University of São Paulo in 1963. In 1981, he obtained his Doctorate in International Law from the University of Paris II. Luiz Olavo Baptista was a lawyer, arbitrator and professor by vocation. He practiced for more than fifty years, and was also involved in many ICC Arbitrations, gaining wide national and international recognition. In 2001, he was appointed by the Brazilian government to be part of the seven-member WTO Appellate Body. Prof. Luiz Olavo Baptista has taught for 30 years at the Faculty of Law of the University of São Paulo, which bestowed him with the Maria Teresa Cristina de Bourbon Chair. He received the Anchieta Medal by the São Paulo City Council, the Barão de Ramalho Award by the São Paulo Lawyers Institute, the High Degree of Distinction by the Superior Military Court and was Grand Officer of the Order of Rio Branco. In 2015, after 50 years of profession, he founded Atelier Jurídico, which specializes in international trade, private law and dispute resolution. Through events, research, publications and teaching, Luiz promoted debates that were fundamental to the development of arbitration as a method of dispute resolution.

Prof. Luiz O. Baptista had an active participation in ICC Arbitration, as a lawyer, an arbitrator, and as member of the ICC Latin American arbitration group. He was also a member of the Council of the ICC Institute of World Business Law since 1999, willing to share his great experience and knowledge by actively contributing to the activities of the Institute as well as to the depth of academic debates during the meetings of the Institute Council. Luiz kindly made himself available on several occasions to read and assess the theses submitted for the Institute Prize, and to participate in the various training sessions organized by the Institute as a means of spreading the knowledge of arbitration around the world and of forming the next generation of arbitrators.

We will remember Prof. Luiz O. Baptista not only for his exceptional contribution to international law, but even more importantly for his great qualities as a person, among which was his infinite generosity. His passing leaves a great void in the world of international law and especially in the arbitral community.

A Corte Internacional de Arbitragem da CCI tomou conhecimento com grande tristeza que nosso colega e amigo Luiz Olavo Baptista nos deixou em 18 de outubro de 2019 em São Paulo.

Luiz Olavo Baptista, nascido na cidade de Itu, em 1938, graduou-se em Direito e Ciências Sociais pela Pontifícia Universidade Católica de São Paulo em 1963. Mais tarde, em 1981, obteve o Doutorado em Direito Internacional pela Universitè de Paris II. Luiz Olavo Baptista foi advogado, árbitro e professor por vocação, exerceu a profissão por mais de cinquenta anos, conquistando grande reconhecimento nacional e internacional, inclusive em muitas arbitragem CCI. Em 2001, foi indicado pelo governo brasileiro para compor a corte de sete juízes da OMC. O Prof. Luiz Olavo Baptista lecionou por 30 anos na Faculdade de Direito da Universidade de São Paulo, que o agraciou com a cátedra Maria Teresa Cristina de Bourbon. Recebeu a Medalha Anchieta pela Câmara Municipal de São Paulo, o Prêmio Barão de Ramalho pelo Instituto dos Advogados de São Paulo, o Alto Grau de Distinção pelo Tribunal Militar Superior e é Grande Oficial da Ordem de Rio Branco. Em 2015, após 50 anos de profissão, fundou o Atelier Jurídico, especializado em comércio internacional, Direito Privado e resolução de disputas. Por meio de eventos, pesquisas, publicações e ensino, promoveu debates que foram fundamentais para o desenvolvimento da arbitragem como método de resolução de litígios.

O Prof. Luiz O. Baptista, teve uma participação ativa na arbitragem CCI, como advogado, como árbitro, como membro do grupo latino-americano de arbitragem da CCI. Foi também membro do Conselho do Instituto de Direito Comercial Internacional da CCI desde 1999. Sempre esteve envolvido nas atividades do Instituto e disposto a compartilhar sua grande experiência e conhecimento: além de contribuir para a profundidade dos debates acadêmicos durante as reuniões do Conselho, gentilmente se colocou à disposição em diversas ocasiões para ler e avaliar teses para o Institute Prize, e para participar nos diversos treinamentos organizados pelo Instituto como forma de difundir o conhecimento da arbitragem no mundo e de formar a próxima geração de árbitros.

Nos recordaremos do Prof. Luiz O. Baptista não só pela sua impar contribuição ao direito internacional, mas ainda mais importante, por suas grandes qualidades como pessoa, entre as quais estava sua infinita generosidade. Sua perda deixou um grande vazio no mundo do direito internacional e, especialmente, na comunidade arbitral.
